Distance Sales Agreement

 

This Distance Sales Agreement ("Agreement") is concluded between:

Seller:
Living Cult by KSM Mimarlık Hizmetleri Ltd. Şti.
("Living Cult", "we", "us", "our")

and

Buyer:
The individual or legal entity completing a purchase through the Living Cult website ("Customer", "you").

By placing an order through the Website, the Customer agrees to be bound by this Agreement.

 

 

Subject of the Agreement

 

This Agreement governs the sale and delivery of products offered on the Living Cult website and, where applicable, inquiry-based products ordered through direct communication with Living Cult.

 

 

Product Information

 

The type, quantity, and essential characteristics of the products are displayed on the Website or provided through individual quotation in the case of inquiry-based products.

 

 

Prices and Payment

 

All prices are stated in Turkish Lira (TRY).

For products purchased through the Website:

  • Taxes are included for orders within Türkiye.

  • Shipping will be shown separately if applicable.

  • Payment is processed securely via Iyzico.

For inquiry-based products:

  • Prices are provided individually in a quotation.

Payment is considered completed once authorised by the payment provider.

 

 

Shipping and Delivery

 

Products available for direct purchase through the Website are shipped from Türkiye to both domestic and international destinations.

For orders delivered within Türkiye, all applicable taxes are included in the product price. Shipping costs, where applicable, are calculated and displayed during checkout before payment is completed.

For international orders, shipping costs are calculated and displayed at checkout before payment is completed.

Customs duties, import taxes and any additional charges imposed by the destination country are not included in the product price or shipping costs unless explicitly stated otherwise. These charges are the responsibility of the Customer.

Living Cult has no control over customs procedures, duties or local import regulations and cannot estimate or reimburse any additional charges imposed by the destination country.

Delivery times are estimates only and may vary due to customs procedures, courier delays or other circumstances beyond our control.

Risk of loss passes to the Customer upon delivery.

Certain products are available exclusively through inquiry and are not sold directly through the Website.

Shipping costs for inquiry-based products are calculated individually and included as separately in the quotation provided by Living Cult.

Unless otherwise agreed in writing, all applicable taxes and customs duties are included in the quotation for inquiry-based products. Shipping costs are quoted separately.

Estimated production and delivery times for inquiry-based products will be communicated individually during the quotation and ordering process.

 

 

Returns & Right of Withdrawal

 

Customers in Türkiye have the statutory right to withdraw from their purchase within fourteen (14) days of receiving their order in accordance with applicable consumer protection laws.

International customers may also request a return within fourteen (14) days of delivery.

To request a return, please contact hello@livingcult.co within 14 days of receiving your order.

Returned products must:

  • be unused,

  • be undamaged,

  • be returned in their original packaging,

  • include all original components.

Customers are responsible for return shipping costs unless the return is due to an error on our part or a defective product.

Refunds will be issued to the original payment method after the returned item has been received and inspected.

We reserve the right to refuse returns that do not meet the above conditions.

 

 

Return Shipping Costs

 

Unless the return is due to a defect, damage, or an error on our part, return shipping costs are the responsibility of the Customer.

Customers are responsible for ensuring that returned items are properly packaged to avoid damage during transit.

 

 

Refunds

 

Once a returned item has been received and inspected, approved refunds will be issued to the original payment method within a reasonable timeframe.

Original shipping charges are non-refundable unless otherwise required by applicable law or where the return results from our error or a verified defect.

 

 

Inquiry-Based Products

 

Products ordered through inquiry are manufactured or prepared specifically for each customer and may include bespoke dimensions, colours, finishes or other custom specifications.

Unless otherwise agreed in writing, inquiry-based products are considered made-to-order and cannot be cancelled, returned or exchanged once production has begun.

 

 

Delivery and Risk Transfer

 

Delivery times are estimates only and may vary due to customs procedures, logistics delays or other external factors.

Risk of loss transfers to the Customer upon delivery of the product to the provided shipping address.

 

 

Damaged or Incorrect Items

 

Please inspect your order immediately upon delivery.

If your order arrives damaged or incorrect, you must contact us within 48 hours of delivery at hello@livingcult.co.

Your message must include:

  • order number,

  • photographs of the product,

  • photographs of the packaging,

  • photographs of the shipping box,

  • a description of the issue.

Claims submitted without sufficient documentation may not be processed.

 

 

Force Majeure

 

Neither party shall be held liable for failure or delay in performance due to events beyond reasonable control, including but not limited to natural disasters, war, pandemics, strikes, transport disruptions or governmental actions.

 

 

Governing Law and Jurisdiction

 

This Agreement is governed by the laws of the Republic of Türkiye.

Any disputes arising from this Agreement shall be subject to the jurisdiction of the competent courts and enforcement offices of Türkiye.
