Distance Sales Agreement

This Distance Sales Agreement ("Agreement") is concluded between:

Seller:
Living Cult by KSM Mimarlık Hizmetleri Ltd. Şti.
("Living Cult", "we", "us", "our")

and

Buyer:
The individual or legal entity completing a purchase through the Living Cult website ("Customer", "you").

By placing an order through the Website, the Customer agrees to be bound by this Agreement.

Subject of the Agreement

This Agreement governs the sale and delivery of products offered on the Living Cult website and, where applicable, inquiry-based products ordered through direct communication with Living Cult.

Product Information

The type, quantity, and essential characteristics of the products are displayed on the Website or provided through individual quotation in the case of inquiry-based products.

Prices and Payment

All prices displayed on the Website are stated in Turkish Lira (TRY). An exchange-rate option is available to view approximate prices in Euros (EUR) and US Dollars (USD).

For products purchased through the Website:

VAT are included for orders within Türkiye, shipping will be shown separately at the check out..
Shipping and VAT (when applicable) for international orders will be shown separately at the check out.
All purchases through the Website are securely processed through Iyzico.
Payment is considered completed once authorised by the payment provider.

For inquiry-based products:

Payment details and instructions will be provided in the quote.
Once the required payment has been received, the order will be confirmed and production will begin.

Shipping and Delivery

Products available for direct purchase through the Website and inquiry-based products are shipped from Türkiye to both domestic and international destinations.

For orders of direct purchase products delivered within Türkiye, all applicable taxes are included in the product price. Shipping costs are calculated and displayed during checkout before payment is completed.

For international orders of direct purchase products, shipping costs and VAT (when applicable) are calculated and displayed at checkout before payment is completed.

For international orders of direct purchase products, customs duties, import taxes and any additional charges imposed by the destination country are not included in the product price or shipping costs unless explicitly stated otherwise. These charges are the responsibility of the Customer.

Certain products are available exclusively through inquiry and are not sold directly through the Website.

Shipping costs and VAT (when applicable) for inquiry-based products are calculated individually and included as separately in the quotation provided by Living Cult.

Estimated production and delivery times for inquiry-based products will be communicated individually during the quotation and ordering process.

For inquiry-based products, customs duties, import taxes and any additional charges imposed by the destination country are not included in the product price or shipping costs unless explicitly stated otherwise. These charges are the responsibility of the Customer.

Living Cult has no control over customs procedures, duties or local import regulations and cannot estimate or reimburse any additional charges imposed by the destination country.

Delivery times are estimates only and may vary due to customs procedures, courier delays or other circumstances beyond our control.

Risk of loss and damage passes to the Customer upon delivery.

Returns & Right of Withdrawal

Customers in Türkiye have the statutory right to withdraw from their purchase within fourteen (14) days of receiving their order in accordance with applicable consumer protection laws.

International customers may also request a return within fourteen (14) days of delivery.

To request a return, please contact hello@livingcult.co within 14 days of receiving your order.

Returned products must:

be unused,
be undamaged,
be returned in their original packaging,
include all original components.

Original shipping costs, customs duties, import taxes, and any additional return shipping costs (where applicable) are non-refundable, unless the return results from a defective or damaged product, or an error attributable to Living Cult.

Refunds will be issued to the original payment method after the returned item has been received and inspected.

We reserve the right to refuse returns that do not meet the above conditions.

Return Shipping Costs

Customers are responsible for ensuring that returned items are properly packaged to avoid damage during transit.

Refunds

Once a returned item has been received and inspected, approved refunds will be issued to the original payment method within a reasonable timeframe.

Inquiry-Based Products

Products ordered through inquiry are manufactured or prepared specifically for each customer and may include bespoke dimensions, colours, finishes or other custom specifications.

Unless otherwise agreed in writing, inquiry-based products are considered made-to-order and cannot be cancelled, returned or exchanged once production has begun.

Delivery and Risk Transfer

Delivery times are estimates only and may vary due to customs procedures, logistics delays or other external factors.

Risk of loss and damage transfers to the Customer upon delivery of the product to the provided shipping address.

Damaged or Incorrect Items

Please inspect your order immediately upon delivery.

If your order arrives damaged or incorrect, you must contact us within 48 hours of delivery at hello@livingcult.co.

Your message must include:

order number,
photographs of the product,
photographs of the packaging,
photographs of the shipping box,
a description of the issue.

Claims submitted without sufficient documentation may not be processed.

Force Majeure

Neither party shall be held liable for failure or delay in performance due to events beyond reasonable control, including but not limited to natural disasters, war, pandemics, strikes, transport disruptions or governmental actions.

Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of Türkiye.

Any disputes arising from this Agreement shall be subject to the jurisdiction of the competent courts and enforcement offices of Türkiye.
