The following Terms & Conditions apply to all purchases and inquiries made through the Living Cult website ("Website") and govern the relationship between you ("Customer", "you") and Living Cult by KSM Mimarlık Hizmetleri Ltd. Şti. ("Living Cult", "we", "our", "us").

By accessing the Website, placing an order, or submitting an inquiry, you confirm that you have read, understood and accepted these Terms & Conditions together with our Privacy Policy and, where applicable, our Distance Sales Agreement.

These Terms apply to all visitors, users and customers of the Website.

Intellectual Property & Design Rights

All content available on this Website, including but not limited to product designs, furniture designs, interior designs, architectural designs, photographs, images, graphics, illustrations, videos, logos, branding, text and website layout, is the intellectual property of Living Cult and/or its original designer, Müge Kahraman, unless stated otherwise.

All products and designs presented under the Living Cult name are original works and are protected under applicable intellectual property, copyright and design laws.

No content or product design from this Website may be copied, reproduced, modified, reverse-engineered, manufactured, distributed, sold or otherwise used in any form without prior written permission from Living Cult.

The purchase of a product does not grant any intellectual property rights to the customer.

Any unauthorised reproduction, imitation or commercial use of Living Cult designs is strictly prohibited. Living Cult reserves the right to take legal action against any infringement of its intellectual property and design rights.

Placing an Order

Before completing a purchase, please ensure that all information provided, including delivery address, billing details and contact information, is accurate.

After placing an order, you will receive an order confirmation email acknowledging receipt of your order. This confirmation does not constitute acceptance of your order.

We reserve the right to refuse or cancel any order at our discretion, including but not limited to pricing errors, suspected fraud, payment issues or product unavailability.

Products Available Through the Website

Products available for direct purchase through the Website are offered subject to availability. As many products are produced in limited batches, availability may change without prior notice.

We reserve the right to modify or discontinue any product at any time.

Inquiry-Based Products

Certain products are not available for direct purchase through the Website and are offered on an inquiry basis only.

Pricing for inquiry-based products is provided individually following consultation and may vary depending on dimensions, materials, finishes or custom requirements.

Unless otherwise agreed in writing, inquiry-based products are considered made-to-order and are produced specifically for each customer.

Made-to-order products cannot be cancelled, returned or exchanged except of a verified manufacturing defect.

For inquiry-based products, customs duties are included in the quotation provided by Living Cult. Shipping costs are calculated and quoted separately.

Pricing

All prices displayed on the Website are stated in Turkish Lira (TRY).

Products purchased through the Website and delivered within Türkiye, all applicable taxes are included in the product price. Shipping costs, where applicable, are calculated and displayed during checkout before payment is completed. For inquiry-based products delivered in Türkiye, all applicable taxes are included while shipping costs will be quoted separately.

Shipping costs for international orders are calculated separately and shown at checkout for Website purchases or included separately in inquiry-based quotations.

We reserve the right to change prices at any time without prior notice.

Payment

Payments are securely processed through Iyzico.

By completing a purchase, you confirm that you are authorised to use the selected payment method.

Orders will only be processed once payment has been successfully authorised.

Living Cult is not responsible for any additional fees or charges imposed by banks or payment providers.

Shipping

Products purchased through the Website and inquiry-based products are shipped from Türkiye to domestic and international destinations.

Delivery times are estimates only and may vary due to customs processing, courier delays or other factors beyond our control.

Risk of loss passes to the customer upon delivery.

Customs & Import Duties

For international orders placed through the Website, customs duties, import taxes and any local charges imposed by the destination country are the responsibility of the customer unless otherwise stated.

These charges are not included in the product price or standard shipping cost shown at checkout. Living Cult has no control over these charges and cannot predict their amount.

For inquiry-based products, customs duties are included in the quotation provided by Living Cult. Shipping costs are calculated and quoted separately.

Returns & Right of Withdrawal

Customers in Türkiye have the statutory right to withdraw from their purchase within fourteen (14) days of receiving their order in accordance with applicable consumer protection laws.

International customers may also request a return within fourteen (14) days of delivery.

To request a return, please contact hello@livingcult.co within 14 days of receiving your order.

Returned products must:

be unused,
be undamaged,
be returned in their original packaging,
include all original components.

Customers are responsible for return shipping costs unless the return is due to an error on our part or a defective product.

Refunds will be issued to the original payment method after the returned item has been received and inspected.

We reserve the right to refuse returns that do not meet the above conditions.

Damaged or Incorrect Items

Please inspect your order immediately upon delivery.

If your order arrives damaged or incorrect, you must contact us within 48 hours of delivery at hello@livingcult.co.

Your message must include:

order number,
photographs of the product,
photographs of the packaging,
photographs of the shipping box,
a description of the issue.

Claims submitted without sufficient documentation may not be processed.

Website Information

We aim to ensure that all information on the Website is accurate and up to date. However, errors may occasionally occur.

We reserve the right to correct any errors, inaccuracies or omissions and to update information without prior notice.

We do not guarantee that the Website will always be available, uninterrupted or error-free.

Force Majeure

Living Cult shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, war, government actions, pandemics, labour disputes, supply chain disruptions, transport issues or technical failures.

Applicable Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Türkiye.

Any disputes arising from these Terms & Conditions shall be subject to the jurisdiction of the competent courts and enforcement offices of Türkiye.

Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time.

The latest version will always be available on the Website and will apply to all orders placed after publication.
